ICJ climate opinion reshapes the legal landscape – Cirio outlines what comes next

On 23 July 2025 the International Court of Justice released its first advisory opinion on State responsibility for climate change. The Court makes clear that the 1.5 °C ceiling, the duty of progressive ambition and the obligation of cooperation and reparation constitute legally binding obligations owed to other States, to people today and to future generations.

Climate diplomacy is thus no longer only a game of politics; it now unfolds within a global rule-of-law framework. The opinion will influence everything from forthcoming Nationally Determined Contributions (NDCs) to corporate transition plans, and it already frames the EU’s ongoing Omnibus negotiations.
